1. Scope These General Terms and Conditions (GTC) apply to all custom orders, such as kitchens, tabletops, and similar products manufactured and delivered by Uniiqo Naturstein GmbH (hereinafter "Uniiqo"). Deviating agreements require the written consent of Uniiqo.

2. Conclusion of Contract 2.1. The contract between Uniiqo and the customer comes into existence through the acceptance of an individual offer. 2.2. The offer is based on the information, sketches, and plans provided by the customer. Changes after acceptance of the offer may incur additional costs.

3. Prices and Payment Terms 3.1. All prices are quoted net plus the statutory value-added tax, unless otherwise stated. 3.2. As these are custom orders, the full invoice amount is to be paid as a deposit upon conclusion of the contract. 3.3. Production begins only after receipt of full payment and the written approval of the design by the customer. 3.4. Payments are to be made without deduction to the account specified by Uniiqo.

4. Production and Delivery 4.1. The production time begins after receipt of the agreed deposit and the written approval of the design by the customer. 4.2. Delivery dates are non-binding unless expressly guaranteed in writing. 4.3. Natural stones are natural products; variations in color, structure, and texture are possible and do not constitute a defect.

5. Special Requests and Changes 5.1. Change requests after the conclusion of the contract must be made in writing and may incur additional costs as well as an extension of the delivery time. 5.2. Uniiqo reserves the right to refuse change requests if they are technically impractical.

6. Acceptance 6.1. The customer is obliged to inspect the goods upon delivery or collection and to report any defects immediately.

7. Warranty and Liability 7.1. The warranty is subject to the statutory provisions. 7.2. Uniiqo assumes no liability for damages resulting from improper use, assembly, or maintenance by the customer. 7.3. For natural stones, deviations in color, veining, and structure are considered characteristic and do not constitute grounds for complaints.

8. Right of Withdrawal 8.1. Since the orders are custom products, cancellation by the customer after conclusion of the contract is fundamentally excluded. Should Uniiqo agree to a cancellation out of goodwill, a compensation amounting to 100% of the order value is payable, regardless of the production status. 8.2. Uniiqo reserves the right to withdraw from the contract if unforeseen circumstances such as force majeure, supply bottlenecks of raw materials, or technical problems make production or delivery impossible. In such cases, the customer will be reimbursed the amount paid minus costs already incurred. 8.3. Any work already performed, drawings made, planning, or reservation of materials are non-refundable and will be charged to the customer.

9. Retention of Title The goods remain the property of Uniiqo until full payment has been made.

10. Data Protection Customer data will be used solely for the purpose of processing the order and will not be passed on to third parties unless required for the fulfillment of the contract.

11. Jurisdiction and Applicable Law 11.1. German law applies to all disputes. 11.2. The place of jurisdiction is Berlin, as far as legally permissible.

12. Final Provisions 12.1. Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected. 12.2. Changes and additions to these GTC must be in writing.
